Why a Spacecraft License Does Not by Itself Establish Permission for a Physical Effect on Earth

This white paper examines the regulatory distinction between spacecraft communications licensing and authorization for physical effects created on Earth using Reflect Orbital’s Earendil-1 demonstration satellite as a case study. While the FCC authorized radiofrequency communications supporting the mission, it explicitly determined that operation of the spacecraft’s solar reflector falls outside its regulatory authority. The paper argues that licensed communications, authenticated commands, and mission approval alone do not establish permission for a specific illumination event. It proposes that future commercial space systems require execution authority that continuously validates location, timing, jurisdiction, environmental conditions, and operational approvals before any physical effect occurs.
