Foreign governments are increasingly using “non-tariff attacks” to weaken U.S. technology companies through discriminatory fines, data localization mandates, and forced technology changes. These measures drain resources that would otherwise fuel innovation, distort global competition, and give an advantage to state-backed foreign rivals—especially China. The paper argues that the U.S. must treat these tactics as strategic threats and respond with stronger trade enforcement, targeted diplomacy, and coordinated technology policy. It highlights the broader implications for national competitiveness, economic security, and America’s leadership in emerging technologies.
